CHILD PORNOGRAPHY
Possession of child pornography and distribution of child pornography are felony offenses. You must have known or had reason to know of the content that you either possessed or disturbed. If you are facing child pornography charges, you may be charged under any of the following subdivisions:
- Dissemination: This charge occurs if you distributed child pornography. If you are charged with child pornography under this subdivision, the penalties include up to 7 years in prison and/or a $10,000 fine, and mandatory predatory offender registration.
- If you were a registered predatory offender with a prior dissemination conviction when you were charged, and the pornography involved a minor under the age of 14 years, the penalties include up to 15 years in prison and/or a $20,000 fine.
- Possession: This charge occurs if you possessed child pornography. If you are charged with child pornography under this subdivision, the penalties include up to five years in prison and/or a $5,000 fine, and mandatory predatory offender registration.
- If you were a registered predatory offender with a prior dissemination conviction when you were charged, and the pornography involved a minor under the age of 14 years, the penalties include up to 10 years in prison and/or a $10,000 fine.
